If there is not enough insurance, there may be more available through any underinsured motorist coverage on your mother's policy. The personal representative, with aid of an attorney, can then either file a lawsuit or try to negotiate with the appropriate insurance company or companies to settle the claim. Oregon law allows up to 3 years to file a wrongful death claim with the court.
