Phantom VehicleQ: I hit a tree when a driver suddenly cut in front of me and forced me off the road. The other driver didn't stop, and I was not able to get the license number. A witness stopped and helped me. My insurance has paid my medical bills and part of my lost wages. Am I entitled to anything more? A: Under the Personal Injury Protection (PIP) portion of your policy, your insurance should pay for reasonable and necessary medical expenses up to at least $10,000 or a year after the accident, plus 70% of your lost income (up to $1,250 per month) if you were disabled for 14 days or more. Under Oregon law, you also have an Uninsured Motorist claim for your injuries. Since there was a witness who can verify that the accident was caused by a "phantom vehicle", you may pursue a claim with your insurance company for any unpaid medical expenses, the remainder of your lost income (not just the portion paid pursuant to the PIP), plus a factor for pain and suffering and any long-term problem you may have due to your injuries.
