I have huge medical bills, plus I can't work for the next two months. What can I do? A: You have two claims. First, you have a Workers' Compensation claim because you were performing an employment-related activity at the time of the accident. Be sure that the claim was reported to your employer. Workers' Comp should pay medical bills and part of your lost income. Second, you have a claim against the other driver for all your damages, including all lost wages and medical bills, plus a factor for pain and suffering and any long-term problems you may have. Workers' Comp will want to get paid back what it paid on your claim, and will ask you to either (a) pursue the other driver by hiring an attorney or (b) allow the Workers' Comp carrier to pursue the claim for you. If you allow the Workers' Comp carrier to pursue the claim, it will try to recover its expenses, but will not try to get you compensation for your pain and suffering.
